Welcome to Pitacca! These Terms of Use ("Terms") govern your access to and use of the Pitacca mobile application ("App"), website, and related services (collectively, the "Service"). By accessing or using Pitacca, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, downloading the App, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Pitacca.
2. Eligibility
You must be at least 18 years of age to use Pitacca. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration and Security
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Maintain the security of your account credentials and accept all risks of unauthorized access
- Immediately notify us of any unauthorized use of your account or any other breach of security
- Be responsible for all activities that occur under your account
We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.
4. Description of Service
Pitacca is a personal finance management tool that helps you:
- Track credit card spending and manage multiple cards
- Monitor budgets and categorize expenses (Needs, Wants, Bills)
- Scan and categorize receipts using optical character recognition (OCR)
- Set billing cycle dates and receive payment reminders
- View spending analytics and insights
- Export financial reports and sync data across devices (Premium feature)
Important: Pitacca is a personal financial tracking tool and does NOT connect directly to your bank accounts or credit card accounts. All data entered into the App is manually input by you or captured via receipt scanning. We do not have access to your actual financial accounts, and we are not a financial institution.
5. User Responsibilities
You are solely responsible for:
- The accuracy of all financial data you enter into the App
- Manually tracking and updating your credit card balances, transactions, and payment due dates
- Ensuring timely payment of your credit card bills and other financial obligations
- Verifying that receipt scans and OCR-extracted data are correct
- Maintaining backups of your financial information
- Making your own financial decisions based on the information in the App
Pitacca is a tracking tool, not a financial advisor. We provide organizational features and insights, but we do not provide financial advice, recommendations, or guidance. You should consult with a qualified financial professional for financial advice.
6. Subscription and Payment Terms
6.1 Free Tier
Pitacca offers a free tier with limited features, including:
- Up to 3 credit cards
- 5 receipt scans per month
- Basic spending tracking and manual expense entry
- Budget setup and billing cycle tracking
6.2 Premium Subscription
Premium subscriptions unlock additional features including unlimited cards, unlimited receipt scans, advanced analytics, smart notifications, cloud backup, and data export. Subscriptions are available on a monthly or annual basis.
Pricing: Subscription pricing is set by the App Store or Google Play Store in your local currency and may vary by region. Current pricing is displayed in the App before purchase.
7-Day Free Trial: New users are eligible for a one-time 7-day free trial of Premium features. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for a subscription.
6.3 Billing and Renewal
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings
- Cancellation takes effect at the end of the current billing period; you will retain Premium access until then
6.4 Refunds
All purchases are processed through the App Store (iOS) or Google Play (Android). Refund requests must be submitted directly to Apple or Google according to their respective refund policies. Pitacca does not process refunds directly.
7. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law
- Violate or encourage others to violate the rights of third parties, including intellectual property rights
- Post, upload, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
- Distribute viruses, malware, or any other technologies that may harm Pitacca, the Service, or other users
- Attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
- Use any robot, spider, scraper, or other automated means to access the Service
- Interfere with or disrupt the integrity or performance of the Service
- Share your account credentials with others or allow others to access your account
- Use the Service to engage in any fraudulent or deceptive practices
8. Intellectual Property Rights
The Service, including the App, website, and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Pitacca, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use. This license does not include any right to:
- Resell or make commercial use of the Service or its contents
- Collect and use any product listings, descriptions, or prices
- Make derivative uses of the Service or its contents
- Download or copy account information for the benefit of another merchant
- Use any data mining, robots, or similar data gathering and extraction tools
9. User Content
9.1 Your Content
You retain all ownership rights to the financial data, receipt images, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.
9.2 Content Standards
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to all User Content you submit
- Your User Content does not violate the privacy rights, publicity rights, copyrights, or other rights of any person
- Your User Content complies with all applicable laws and regulations
9.3 Receipt Scanning and OCR
Receipt images you upload are processed using optical character recognition (OCR) technology to extract transaction information. You acknowledge that:
- OCR accuracy may vary depending on receipt quality and format
- You are responsible for verifying all extracted data for accuracy
- Receipt images may be temporarily stored for processing purposes
- We do not guarantee 100% accuracy of OCR-extracted data
10. Cloud Backup and Data Sync (Premium Feature)
Premium subscribers can enable cloud backup to sync their financial data across devices. By enabling this feature:
- Your data will be encrypted and stored on our secure servers
- You acknowledge that data transmission over the internet carries inherent risks
- You are responsible for maintaining local backups of important financial information
- We will make reasonable efforts to maintain data integrity but are not liable for data loss
11. Third-Party Services and Links
The Service may contain links to third-party websites, services, or resources. We provide these links only as a convenience and are not responsible for the content, products, or services available from these third parties. Your use of third-party websites and resources is at your own risk and subject to the terms and conditions of those third parties.
12. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using the Service, you consent to our collection and use of personal data as outlined in the Privacy Policy.
13. Disclaimers and Limitations of Liability
13.1 No Financial Advice
PITACCA IS NOT A FINANCIAL ADVISOR. The Service provides tools for tracking and organizing financial information but does not constitute financial, investment, tax, or legal advice. You should consult with qualified professionals for advice specific to your situation.
13.2 No Guarantee of Accuracy
While we strive to provide accurate tools and features, we do not guarantee that:
- The App will be error-free or uninterrupted
- Defects will be corrected
- The Service is free of viruses or other harmful components
- OCR and receipt scanning will be 100% accurate
- Budget calculations or spending insights will be perfectly accurate
13.3 "AS IS" and "AS AVAILABLE"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITACCA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code that may be transmitted to or through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service
- Financial decisions made based on information tracked in the App
- Missed payments, late fees, or other financial consequences resulting from reliance on the App's reminders or notifications
IN NO EVENT SHALL PITACCA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO PITACCA IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify, defend, and hold harmless Pitacca, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights or privacy rights
- Your User Content or any content you submit to the Service
- Your use or misuse of the Service
15. Termination
15.1 Termination by You
You may stop using the Service at any time. You can delete your account from within the App settings. Upon deletion:
- Your data will be permanently deleted from our servers within 30 days
- Active subscriptions will continue until the end of the current billing period
- No refunds will be provided for partial subscription periods
15.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
15.3 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
- You will no longer have access to your data unless you exported it before termination
16. Changes to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
17. Changes to Terms
We may update these Terms from time to time. When we make changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you through the App or via email
- Post the updated Terms on our website
Your continued use of the Service after changes to the Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions.
18.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue legal remedies in the appropriate courts of the Philippines.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pitacca regarding the Service and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
19.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.

21. Additional Terms for iOS Users
If you download the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and Pitacca only, not with Apple Inc. ("Apple")
- Apple has no obligation to furnish any maintenance and support services with respect to the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App
- Apple is not responsible for addressing any claims you may have relating to the App or your use of it
- Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, will have the right to enforce these Terms against you as a third-party beneficiary
22. Additional Terms for Android Users
If you download the App from Google Play, you agree to comply with Google's Terms of Service and Google Play's Terms of Service, which are incorporated herein by reference.
